Use of Services

This website is owned and operated by Eli-Vated Living.
Your use of this website constitutes your agreement to be bound by these terms and conditions.

The products available on this website are intended for laboratory and research use only, unless otherwise explicitly stated. They are not intended for human ingestion or for use in products that may be ingested. You must be at least 21 years of age to purchase goods on this website.

In purchasing these products, the customer acknowledges that there are hazards associated with their handling and use. Customer represents and warrants to us that from customer’s own independent review and study they are fully aware and knowledgeable about (I) the health and safety hazards associated with the handling of the products purchased; (II) industrial hygiene controls necessary to protect its workers from such health and safety hazards; (III) the need to adequately warn of health and safety hazards associated with products; and (IV) government regulations regarding the use of and exposure to such products.

Buyer realizes that, since supplier products are, unless otherwise stated, intended primarily for research purposes, they may not be on the Toxic Substances Control Act (TSCA) inventory. Buyer assumes responsibility to assure that the products purchased from Eli-Vated Living are approved for use under TSCA, if applicable.

Buyer further warrants to supplier that any material produced with products from supplier shall not be changed, altered, modified, adulterated, or misbranded, under the Federal Food, Drug, and Cosmetic Act or is an article which may not, under the provisions of section 404, 505, or 512 of the act, be introduced into interstate commerce.

We reserve the right to limit sales of products or not to sell products to unqualified customers.
In no event shall Eli-Vated Living or any of its affiliates be liable for special, incidental, or consequential damages, whether purchaser’s claim in contract, negligence, strict liability, or otherwise.

By purchasing from Eli-Vated Living or any of its affiliates, Buyer understands and agrees that the products are not offered or sold for human or animal consumption of any kind, type, and methodology, whatsoever.

Buyer acknowledges that the products have not been tested by supplier for safety and efficacy in food, drug, and medical device, cosmetic, commercial, or any other use. Buyer expressly represents and warrants to supplier that Buyer will properly test and use any products purchased from supplier and/or materials produced with products purchased from supplier in accordance with the practices of a reasonable person who is an expert in any appropriate scientific field of study and in strict compliance with all applicable state and federal laws and regulations, now and hereinafter enacted.



Indemnity Waiver

Indemnity Waiver for Eli-Vated Living

In consideration of my purchase of research compounds from Eli-Vated Living, I, the undersigned customer, agree to indemnify, defend, and hold harmless Eli-Vated Living, including its officers, directors, employees, agents, and affiliates (collectively referred to as the “Company”), against any and all claims, liabilities, losses, damages, costs, and expenses, including reasonable attorneys’ fees, arising from or related to the purchase, possession, or use of these research compounds.

I acknowledge and accept that the research compounds provided by the Company are intended solely for research purposes and have not been approved by the U.S. Food and Drug Administration (FDA) for human use.
I commit to using these compounds in compliance with all relevant laws and regulations and assume full responsibility for any risks associated with their purchase, possession, and use.

I hereby release, discharge, and waive any claims, demands, causes of action, suits, judgments, and liabilities of any kind that may arise from or be associated with the purchase, possession, or use of these research compounds.

Furthermore, I agree to defend, indemnify, and hold harmless Eli-Vated Living from any claims, liabilities, damages, expenses, and losses, including but not limited to personal injury, property damage, or any other harm, whether direct or indirect, foreseeable, or unforeseeable, resulting from or connected to the purchase, possession, or use of these research compounds

This indemnity waiver is binding on me, my heirs, executors, administrators, successors, and assigns.

By purchasing research compounds from Eli-Vated Living, I confirm that I have read and understood this Indemnity Waiver. I voluntarily agree to its terms and conditions and certify that I am purchasing these products solely for commercial Research Use Only (RUO) and that I am qualified and authorized to use them for such purposes in compliance with applicable federal and state laws and regulations.

This waiver shall be governed by and construed in accordance with the laws of the California, without regard to any principles of conflicts of law. Any legal action or proceeding arising under this waiver will be brought exclusively in the courts of the state of California, and the parties hereby irrevocably consent to the personal jurisdiction and venue
